I smell a lawsuit coming your way 'Frito Lay' whether you took this man's idea and ran with it or not. In fact, it sounds like to me that you not only adopted his hot chip recipe, but you made changes to it so that you could claim his idea was all yours all along.
Not so fast, Frito is bobbing department heads! Last I checked, you can't just take someone else's invention without proof that they were the person who invented it. This Variety article stated that investigators were sent to get to the truth of the matter. They (the investigators) surmised that Mr. Montañez played a small role in the making of the Flaming’ Hot Cheetos. But, how did they reach such a conclusion without Mr. Montañez's involvement back-story?
Also, I pick up on double talk as Frito Lay mentioned that Mr. Montañez worked at the company as a janitor but advanced quickly to an executive position in a short time (1989 – 1991). TRIGGER ALERT!: This is too hard to figure out because it sounds suspicious and never happens in the real world unless the employee did something to cause the company to bring in great revenue. So, I ask this question, “What could a janitor do to be given an executive position?”
Ways Mr. Montañez could have earned the executive promotion:

- He could have attended college and earned or finished his Bachelor’s or Master’s Degree in Business. This wasn’t the case with him.
- He could have married into a top-leaders family (nepotism) in the company. This also didn’t happen in his case.
- Oh, I don’t know, “He could have actually created the Flaming’ Hot Cheetos recipe in his kitchen, where Frito Lay appointed a scientist to inspect the recipe like he said he happened; so Frito Lay promoted him!” Yeah FL, this doesn’t sound at all suspicious!
